These Terms of Service govern your use of the Aquadayum mobile application ("the App") provided by Wael Al Fatayri ("we", "us", or "our"). By downloading or using Aquadayum, you agree to these terms. Please read them carefully.

01 Acceptance of Terms
By creating an account or otherwise using Aquadayum, you confirm that you are at least 13 years of age and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the App.
If you use Aquadayum on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
02 Description of Service
Aquadayum is an AI-powered aquarium management application that allows you to track water parameters, manage livestock and plant records, log maintenance activities, and use AI features including species identification and tank health analysis.
The App is provided "as is" and "as available". We reserve the right to modify, suspend, or discontinue any part of the App at any time with reasonable notice where possible.
03 Subscriptions & Billing
Aquadayum offers two service tiers:
- Core tank tracking features
- Limited AI usage per day
- Basic maintenance logging
- Everything in Guppy
- Higher daily AI usage limits
- Priority features & early access
Billing & Renewals
Paid subscriptions are processed exclusively through the Apple App Store. By subscribing, you agree to Apple's payment terms. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time via your Apple ID settings.
Refunds
All purchases are subject to Apple's refund policy. We do not process refunds directly. To request a refund, contact Apple through the Report a Problem portal.
Price Changes
We reserve the right to change subscription pricing with at least 30 days' notice. Continued use of a paid subscription after a price change constitutes acceptance of the new price.
04 AI Features & Usage Limits
Aquadayum's AI features — including species identification and tank analysis — are powered by Anthropic's Claude AI. To ensure fair access for all users, daily usage limits apply to both free and paid tiers.
- Guppy (Free): A limited number of AI requests per day.
- Shark (Paid): A higher daily limit, reflecting the subscription benefit.
Specific limit values are displayed within the App and may be adjusted from time to time. Unused AI credits do not roll over to the next day.
We reserve the right to throttle or temporarily suspend AI access for any account exhibiting abnormal usage patterns, even within stated limits.
05 Acceptable Use
You agree to use Aquadayum only for its intended purpose of personal aquarium management. You must not:
- Use automated scripts, bots, or programmatic tools to send requests to the AI features.
- Attempt to circumvent or exploit daily AI usage limits.
- Reverse-engineer, decompile, or disassemble any part of the App.
- Share, sell, or transfer your account to another person.
- Upload content that is illegal, harmful, abusive, or infringes any third-party rights.
- Use the App in any way that could damage, disable, or impair our servers or infrastructure.
- Attempt to gain unauthorised access to other users' accounts or data.
Violation of these rules may result in immediate account termination and, where appropriate, reporting to relevant authorities.
06 Account Termination
Termination by You
You may delete your account at any time via Account → Delete Account in the App. Deletion permanently removes your data and cannot be undone. If you have an active paid subscription, please cancel it via Apple before deleting your account to avoid further charges.
Termination by Us
We reserve the right to suspend or permanently terminate your account, with or without notice, if you:
- Violate these Terms of Service, particularly the Acceptable Use policy.
- Engage in abusive behaviour towards AI features (scripting, botting, limit exploitation).
- Provide false information during account registration.
- Take any action that we reasonably believe causes harm to other users or to us.
We will make reasonable efforts to notify you before termination unless doing so would compromise security or legal compliance. Upon termination, your right to use the App ceases immediately.
07 Your Content & Data
You own all content and data you create within Aquadayum — your tank records, parameter logs, photos, notes, and any other information you enter into the App.
By using the App, you grant us a limited, non-exclusive licence to store, process, and transmit your data solely for the purpose of providing the service to you, including sending relevant data to third-party providers as described in our Privacy Policy.
We do not claim ownership of your data and will never use your content for advertising or sell it to third parties.
08 Disclaimer of Warranties
The App is provided "as is" and "as available", without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties including, but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the App will be uninterrupted, error-free, or free of harmful components.
- Warranties that data will be stored without loss or corruption.
We strongly recommend maintaining your own backups of important aquarium records independently of the App.
09 AI Recommendations Disclaimer
Important: AI-generated species identifications, water parameter analyses, and care recommendations provided by Aquadayum are advisory only. They are not a substitute for professional aquarium advice, veterinary guidance, or your own informed judgement.
Aquadayum and Wael Al Fatayri accept no liability for the death, illness, or injury of fish, corals, invertebrates, plants, or any other livestock or animals as a result of following AI-generated recommendations within the App.
AI models can make mistakes. Always verify identification results and care recommendations against reputable sources and, where appropriate, consult a professional aquarist or veterinarian. You use AI features at your own risk.
10 Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Wael Al Fatayri, as the developer of Aquadayum, be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data or profits.
- Death or injury to aquatic livestock.
- Loss resulting from reliance on AI-generated advice.
- Service outages or data unavailability.
Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $10 if you have not made any payment.
Some jurisdictions do not allow exclusion of certain warranties or limitations of liability, so the above may not apply to you in full.
11 Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.
Any disputes arising from or relating to these terms or your use of Aquadayum shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates, unless otherwise required by mandatory consumer protection laws in your jurisdiction.
12 Changes to Terms
We may update these Terms of Service from time to time. When we do, we will revise the effective date at the top of this page. For material changes, we will notify you via email or an in-app notification at least 14 days before the changes take effect.
Your continued use of Aquadayum after changes are posted constitutes your acceptance of the revised terms. If you do not agree with updated terms, you should stop using the App and delete your account.
